In 2024, the Georgia Legislature passed Senate Bill 351, which prohibits social media companies from allowing any person under 16 from creating an account, unless they can obtain parental consent. Enforcement of this law is currently enjoined by the district court’s decision in NetChoice v. Carr. SB 343 would widen these restrictions by prohibiting social media companies from allowing any person under 14 from creating an account and requiring minors above the age of 14 to obtain parental consent before creating an account.

Given that minors and adults use social media platforms to engage in constitutionally protected speech, the ACLU of Georgia opposes SB 343 because it likely violates their First Amendment rights.
